1. Acceptance of These Terms
By accessing our website, booking services, purchasing packages, or participating in any training session, program, class, or event (collectively, “Services”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the website or Services.
2. Services & Not Medical Advice
Forever Fit provides fitness coaching and personal training services. We are not a medical provider. Content on our website and any training guidance is for general educational and fitness purposes and is not medical advice, diagnosis, or treatment.
Always consult a physician before starting a new exercise program—especially if you are pregnant, postpartum, injured, have chronic conditions, or have been advised to limit physical activity.
3. Eligibility
You must be at least 18 years old to book Services unless a parent/legal guardian signs required forms and provides written consent and is present as required by law or policy.
4. Health, Safety & Client Responsibility
You agree that:
You are responsible for your physical condition and limitations.
You will disclose relevant injuries, conditions, medications, or restrictions that could affect training.
You will follow safety instructions and use equipment responsibly.
You will stop activity immediately if you feel dizziness, pain, faintness, or unusual discomfort and notify Nicole immediately.
5. Assumption of Risk; Waiver & Release (Important)
Physical activity involves inherent risks, including serious injury or death. By participating in Services, you voluntarily assume all risks of injury, illness, damage, or loss.
As a condition of receiving Services, you may be required to sign Forever Fit’s Assumption of Risk, Waiver and Release of Liability, and Indemnity Agreement (“Waiver”). That Waiver is incorporated by reference into these Terms. If there is any conflict between these Terms and the Waiver, the Waiver controls for liability-related issues.
This does not attempt to waive gross negligence or intentional misconduct.
6. Indemnification
To the fullest extent permitted by Washington law, you agree to indemnify and hold harmless Forever Fit with Nicole Pitts, LLC, Nicole P. Pitts, and any affiliates, employees, contractors, agents, representatives, successors, and assigns from claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your participation in Services, your breach of these Terms, or your misuse of equipment/premises.
7. Scheduling, Late Arrivals, No-Shows
Sessions must be scheduled in advance unless otherwise agreed.
If you arrive late, your session may still end at the scheduled time to avoid impacting other clients.
Repeated late arrivals/no-shows may result in refusal of future bookings.
8. Payments, Packages, and Expiration
Payment is due before or at the time of service unless otherwise stated in writing.
Unused sessions are non-refundable unless required by law or agreed in writing.
9. Training Location; Premises Rules
Services may occur at a facility, outdoors, at your home, or another agreed location. You agree to follow facility rules and to be respectful of equipment, staff, and other clients. You assume risks related to travel to/from sessions and being on any premises, including sidewalks, parking lots, stairs, and common areas.
10. Photography & Video Consent
Forever Fit may take photos or video during training for marketing, website, and social media. Content will be stored securely and deleted when no longer needed.
If you do not want to be photographed/recorded, you must notify Nicole in writing at nicpitts@gmail.com before your session.
If you previously consented and change your mind, you may revoke consent going forward by emailing us. (Revocation cannot retroactively remove content already printed/published, but we’ll make reasonable efforts.)
11. Website Use; Intellectual Property
All website content (text, graphics, logos, photos, videos, programs) is owned by Forever Fit or licensed to us and may not be copied, reproduced, or distributed without written permission.
12. Third-Party Links & Tools
Our website may link to third-party sites or use third-party scheduling/payment platforms. We are not responsible for their content, security, or practices. Your use of those services is subject to their terms and privacy policies.
13. Disclaimers
The website and Services are provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose. Results vary by individual and are not guaranteed.
14. Limitation of Liability
To the fullest extent permitted by Washington law, Forever Fit’s total liability for any claim related to the website or Services will not exceed the amount you paid to us in the 30 days preceding the event giving rise to the claim.
15. Governing Law; Venue
These Terms are governed by the laws of the State of Washington. Venue for disputes shall be in Douglas County, Washington, unless otherwise required by law.
16. Changes to Terms
We may update these Terms at any time. Updates will be posted with a new Effective Date. Continued use of the website or Services after changes means you accept the updated Terms.
